![Here’s the truth: not every question is fair game in an interview. In fact, some common “small talk” questions can land you in legal hot water.
❌ “Do you have kids?”
❌ “Where are you originally from?”
❌ “What year did you graduate?”
👉 These seem harmless… but they actually open the door to discrimination claims (age, family status, national origin, etc.).
And here’s the kicker: this applies everywhere in the U.S. Federal law protects candidates from discrimination based on age, race, sex (including pregnancy), religion, national origin, disability, and more.
✨ Some states go even further (examples):
• California → You can’t ask about salary history, and under the Fair Chance Act you can’t ask about conviction history until after a conditional offer.
• Washington (state) → Adds protections for military/veteran status (and in Seattle, political ideology is also protected).
• Massachusetts → You can’t ask about wage/salary history before making an offer.
• Colorado → “Ban the Box”: no criminal history questions on the initial application.
💡 Many other states have similar additional protections, so it’s always smart to check your local laws before hiring.
As a practice owner, focus on skills, clinical judgment, and alignment with your practice values, not personal details that can get you into trouble.
✨ Instead, try reframing:
✅ “Tell me about your experience supporting clients with [specific population/issue].”
✅ “What drew you to working in this modality or setting?”
You can still connect on a human level without crossing compliance lines.
